Non-Disclosure of Commission

In November 2014, the Supreme Court ruled in the case of Plevin v Paragon Personal Finance Limited.

In this case, the Court ruled that failure by the lender to tell the customer about high commissions made the relationship between the lender and its customer unfair under the Consumer Credit Act 1974.

As a result of the Supreme Court’s ruling, the FCA introduced some additional rules and guidance to enable firms to deal with PPI complaints which are impacted by this ruling.
